IBINASURA  ng Sandiganbayan 7th Division ang kaso laban sa mga opisyal ng militar at pulisya na kinalaman sa kaso ng  Morong 43 noong 2010.

Sa  desisyon ng graft court, kinatigan nito ang demurrer to evidence na inihain ng mga akusado.

Ayon sa Sandiganbayan, walang sapat na ebidensya na magsasabing guilty beyond reasonable doubt ang mga akusado.

Ang mga opisyal na una nang kinasuhan ng paglabag sa  Republic Act 7437 o Rights of Persons Arrested, Detained or Under Custodial Investigation ay sina  Lt. Gen. Jorge Segovia, retired Maj. Gen. Aurelio Baladad, Brig. Gen. Joselito Reyes, Col. Cristobal Zaragoza, Police Supt. Marion Balonglong, Police Supt. Allan Nobleza, at Army Major Jovily Cabading.

Inutos din ng graft court na alisin na sa hold departure order ang mga akusado.

“The bond posted by accused for their provisional liberty during the pendency of these cases are ordered cancelled and returned to said accused, subject to any liability of bond. The Hold Departure Order (HDO) issued against accused in these cases is hereby recalled,”nakasaad sa 39 pahinang desisyon.

Inaresto ang 43 health workers na tinawag na Morong 43 matapos akusahang mga miyembro ng New People’s Army sa Morong, Rizal noong 2010 dahil sa illegal possession of explosives.

Napakawalan din ang Morong 43 matapos ang 10 buwan kasunod ng pagbawi ng Department of Justice (DoJ) sa kaso laban sa kanila.
