NAKASALALAY sa mga kamay ni House Speaker Lord Allan Velasco ang kinabukasan ng Impeachent complaint na isinampa laban kay Supreme Court Associate Justice Mario Victor “Marvic” Leonen.

Ito ang pahayag ng isang beteranong mambabatas sa Kamara kaugnay ng inihaing Verified Complaint for Impeachment ni FLAG Secretary General Edwin Cordevilla laban kay Leonen noong Lunes.

“Without Speakers’ support, hindi yan aarangkada,” pahayag ng mambabatas na hindi na nagpabanggit ng pangalan kapalit ng impormasyong ito, base aniya sa mga nakaraang impeachment case na nagtagumpay sa Kamara.

Inihalimbawa nito ang impeachment case na isinampa kay dating Pangulong Joseph “Erap” Estrada noong 2000 kung saan dahil sa suporta ng noo’y Speaker na si Manny Villar ay agad naiakyat ang article of impeachment sa Senado na siyang tumayong Impeachment court.

Ganito rin aniya ang nangyari sa impeachment case kay dating Chief Justice Renato Corona noong 2011 na kaya lang nagtumpay ay dahil suportado ito ni dating House Speaker Feliciano Belmonte Jr.

“So dapat may support si Speaker Lord dyan. Inaantay lang ng mga congressman ang posisyon ng speaker at kung ano ang desisyon ng speaker ‘yun na rin ang desisyon ng majority,” ayon pa sa impormante.

Sa ngayon ay hindi pa iniendorso ng House committee on rules sa House committee on Justice ang impeachment complaint na inihain ni Cordevilla laban kay Leonen.

Base sa proseso, may 60 session days ang Rules committee na magpasya kung ipapasa ang impeachment complaint sa Justice committee subalit hindi na ito susundin kapag umabot sa 1/3 ng miyembro ng Kamara ang mag-eendorso sa nasabing kaso at agad itong iaakyat sa Senado.

Mayroon ding 60 session days ang Justice committee na magpasya sa sufficiency ng form and substance ng kaso kung hindi makakuha agad ng sapat na bilang ng mga endorser saka ito pagbobotohan sa plenaryo kung saan nangangailangan ng majority vote o 152 sa 303 congressmen para litisin ng Senado si Leonen.

“Yang mahabang process na ‘yan maso-shortcut yan kapag sinuportahan ng speaker ang impeachment complaint. May say talaga dyan ang Speaker,” ayon pa sa mambabatas.

Noong Lunes, Disyembre 7, 2020 ay sinampahan ni Cordevilla si Leonen ng impeachment complaint dahil sa culpable violation of the constitution at betrayal of public trust.

Kaugnay ito ng pagpapatulog umano ni Leonen sa may 37 kaso sa Korte Suprema na ibinigay sa kanya para desisyunan bukod sa election protest laban sa mga nakaupong kongresista.

Kaugnay nito, sa isang panayam kay Deputy Speaker Rufus Rodriguez, kung posibleng mangyari kay Leonen ang sinapit ni dating CJ Ma. Lourdes Sereno na napatalsik sa pamamagitan ng quo warranto, pinasubalian ito ng mambabatas.

“That cannot happen because the Constitution is very clear. Impeachable officials like Supreme Court associate justices can only be removed by impeachment. And the Constitution is supreme over the rules of court, definitely. And so I believe that it was a mistake for the Supreme Court to proceed with the quo warranto especially because at that time Congress had already been hearing the impeachment. So we in the House will insist on the constitutional provision, that we have the power, the exclusive jurisdiction to be able to determine whether an official, who is impeachable, there is basis for the sending of the complaint and the articles of impeachment to the Senate. So we will insist on that. This committee with our chairman justice Ching Veloso, we will ensure that we follow the Constitution this time,” pahayag ni Rodriguez. (BERNARD TAGUINOD)
