‘Di pwede magtalaga ng gobernador MARCOS JR. SASABIT SA ‘BULONG BRIGADE’

HINDI malayong sumabit si Pangulong Ferdinand Marcos Jr. kung patuloy na pakikinggan ang ‘bulong brigade’ sa Palasyo, ayon sa isang beteranong abogado.

Pagbubunyag ni Atty. Manuel Luna na kilala bilang de-kampanilyang election lawyer, mayroon di umanong pilit na gumagapang sa Palasyo para kumbinsihin ang Pangulo na magtalaga ng bagong gobernador at bise gobernador sa nahating lalawigan ng Maguindanao.

Sa isang pulong-balitaan, inamin ni Luna na mali sa ilalim ng umiiral na batas ang pagtatalaga ng bagong gobernador sa ilalim ng doktrina ng ‘assumption of regularity.’

Partikular na tinukoy ni Luna ang di umano’y ‘paggapang ng bulong brigade’ para palitan si Maguindanao del Norte Gov. Bai Sinsuat.

“Napilitan na ako magsalita out of malasakit sa Pangulong pilit pinapakain ng mga maling impormasyon,” wika ng abogado.

Sa ilalim ng Transition Law, ang orihinal na lalawigan ng Maguindanao, partikular sa Section 50 ng Republic Act 55110, vice governor ang dapat umupo bilang acting governor ng Maguindanao del Sur.

“There was wrong information and advice to the President regarding the Maguindanao del Norte former Vice Gov. and now Gov. Bai Eilene Sinsuat based on RA 55110, the former no. 1 provincial board member is now the vice gov. of Maguindanao del Norte,” sabi ni Atty. Luna.

“There are reports that some quarters would not want the sitting governor and vice-governor to be in the position who have assumed their office and have discharged their functions already,” dagdag pa niya.

Binanggit ni Luna na meron ng Notice of Allotment mula sa Department of Budget and Management (DBM). Aniya naglaan ang DBM ng P1.9-bilyon Internal Revenue Allotment (IRA) para sa Maguindanao del Sur at P1.8-bilyon naman para sa Maguindanao del Norte.

“News in the VLOG has it that the PNP leadership and the DILG Sec. Benjamin Abalos, Jr. has already established 2 new PPOs one in Maguindanao del Sur and one in Maguindanao del Norte which recognized the two provinces,” sabi pa ng abogado.

“Why will you put up a PPO in Maguindanao del Norte if the assumption of Gov. Bai Eilene Sinsuat is not valid. Why will Gen. Azurin implements the order of SILG Abalos if such an order is not valid,” katwiran ni Luna.

Sinabi pa ng abogado – “Bakit ang mga empleyado ng Maguindanao del Norte naglilipatan na sa Maguindanao del Sur kung hindi valid ang pag-upo ng mga opisyal? I’m not favoring the officials down there, but I pity President Marcos for he already has many problems for the nation every day,” sabi ni Luna.

“Republic Act 55110 mandates the Maguindanao officials to assume office in Maguindanao del Sur, otherwise, it would be dereliction of duty or guilty of abandonment,” dagdag pa nito.

Sa Saligang Batas, umiiral ang tripartite system ng gobyerno. Ang Presidente ang nagpapatupad ng batas, Kongreso ang gumagawa ng batas at Supreme Court naman ang nagpapaliwanag ng batas.

“For valid cause, the Comelec can suspend an election. Since Congress has not repealed RA11050, if the soon to be appointed officials would be allowed to assume office, there would be problems in governance. As the law has not been amended, hence, nobody can be appointed as officials of Maguindanao del Norte,” paliwanag ni Atty. Luna.

Ayon pa sa dating tagapagsalita ng Presidential Anti Corruption Commission (PACC), hindi papayag ang mamamayan ng Maguindanao del Norte na magkaroon ng dalawang ‘sitting governors.’

“That’s why I’m forced to defend the President. The President deserves to have a balanced view. Huwag nating bigyan ng problema ang Pangulo, especially now that nagrerecover pa lang tayo mula sa pandemya. Tinutulungan ko si PBBM at VP Inday Sara out of volunteerism. I’m just a party to the 110 million Filipinos. It’s my duty to protect the President.” ayon pa sa abogado.

Wala rin aniyang katotohanan ang bulong hinggil sa pagkadiskaril ng peace process sa sandaling ‘di palitan ang mga iniluklok ng mga taga Maguindanao.

“How could this affect the peace process, when in fact, the peace process has already rolled out. There is already a law on the peace process. The least we can do is to help the President as we have the problems in Negros Oriental and the higher prices of some agricultural products. ‘Tulungan nyo ako’ is what President Marcos has always appealed to the Filipino people, ” paliwanag pa ni Atty. Luna.

May dalawang mukha aniya ang kwento sa usapin ng demokrasya at mayroon ding dalawang mukha ang katotohanan.

“I believe Executive Secretary former Chief Justice Lucas Bersamin and Chief Presidential Legal Counsel former Senate President Juan Ponce Enrile would wisely advise President Marcos, Jr. on the brewing problem insofar as Maguindanao del Sur and Maguindanao del Norte are concerned. He deserves (PBBM) all the support, sabi ni Atty. Luna.

Giit pa ni Luna, ang pag-upo ng mga opisyal ng Maguindanao del Norte pati na ang notice of allotment ng DBM ay naaayon sa ‘assumption of regularity,’ at di dapat bahirin ng pulitika.

“The President should be defended and supported. The least that I can do is to express my view on the matter.”
