JPE: ESTATE TAX, HINDI UTANG NI BBM

WALANG pananagutan si presidential frontrunner Ferdinand ‘Bongbong’ Marcos, Jr., hinggil sa estate tax na pilit ibinabato sa kanya ng mga kalaban.

Ayon kay dating Senate President Juan Ponce Enrile, ang anumang tax liabilities na kinakaharap ngayon ng Marcos estate ay hindi maaaring ipasa kay BBM, lalo’t karamihan sa mga ito ay dinidinig pa hanggang ngayon sa Court of Appeals at Supreme Court.

Si Enrile, kilalang tax expert ay nagtapos ng Masters of Laws degree sa Harvard School of Law na may specialization sa international tax law.

Sinabi nitong bago dapat maningil ang Bureau of Internal Revenue (BIR) kina BBM at nanay na si dating First Lady Imelda Marcos bilang administrator ng family estate, kailangan ay matapos muna ang usapin nito sa hukuman.

Napaulat kamakailan na pinamamadali ng Department of Finance ang pangongolekta nang BIR sa estate tax na sinasabing ang dating P23 billion ay lumobo na sa P203 billion.

Nitong nagdaang Disyembre, sumulat ang BIR sa mga tagapagmana ni Marcos upang hilingin ang pagbabayad ng kaukulang buwis.

Ngunit para kay Enrile, ang trabaho ng mga estate administrator ay: “to gather the assets, gather the liabilities, and then establish the plan of partition, sell the assets to pay liabilities.”

Sakali aniyang hindi maibenta ng mga administrator ang assets para sa pag-liquidate sa liabilities, at maisama ito sa ‘tax returns,’ wala pa ring paglabag dito para kina BBM, ani Enrile.

Aniya, kailangan ni Marcos ay pagsamahin ang lahat ng mga asset at liabilities, saka ito i-liquidate.

“Then after paying the liabilities…after paying all the taxes they will submit to the court…partition of estates…he has to file an estate return,” dagdag niya.

Mahaba rin aniyang proseso ito dahil ilan sa mga ari-arian o assets ay ipinalalagay na mga ill-gotten wealth ng pamahalaan.

Sa kabila ng Supreme Court ruling noong June 5, 1997 sa Marcoses’ estate tax liability, may mga nakabinbin pa ring usapin kaugnay ng mga naiwang ari-arian na dapat resolbahin.

 

Samantala, sinabi naman ni dating Internal Revenue Deputy Commissioner Edwin Abella na magkaiba ang tungkulin ng isang estate ng ‘executor’ at ‘administrator. ’
Kaya magkaiba aniya ang TIN [tax identification number],” ani Abella, na isang tax law professor and bar reviewer.

“It means that the government or the BIR in particular just needs to go after the estate itself,” sabi pa niya

“The power to tax involves the power to destroy, citing the case of McCulloch v. Maryland 17 US 316 (1819) —Chief Justice John Marshall, “Hence, it must be used judiciously and not treacherously,” sabi ni Abella.

“Lady justice is blind, let us not use our tax laws like Damocles’ sword; taxation is not a weapon but rather our equitable contribution to a just and civilized society. Justice must always be tempered with compassion and mercy,” wika pa niya.

Ayon kay Abella, kahit si President Rodrigo Duterte, “cannot reverse the decision nor preempt and make the decision himself. The tax code is clear on this.”

The Marcoses “have been subjected to harassment since they left office, in fact, their properties have been subjected to auction, and have been sequestered.”

Idinagdag nitong ang pamahalaan ay maaari lamang makakuha ng ilan sa estate na maaaring mabuwisan at hindi ang kabuuang ari-arian dahil itinuturing itong “unconscionable”.
