MULING umapela si Senador Leila M. de Lima sa Muntinlupa City Regional Trial Court (RTC) Branch 205 na irekonsidera ang naunang desisyon nito na tumatabla sa kanyang omnibus motion upang makalahok sa Senate session sa pamamagitan ng teleconferencing sa loob ng kanyang kulungan sa PNP Custodial Center sa Quezon City.

Sinabi ni De Lima sa pitong-pahinang Motion for Reconsideration na inihain nitong Hunyo 22, hiniling nito sa korte na pinamumunuan ni Judge Liezel Aquitan na ikonsidera ang June 17 Joint Order na tinatapos ang kanyang apela na lumahok sa Senate session sa pamamagitan ng teleconferencing “dahil magkaiba ito kung papayagan siyang pisikal na dumalo.”

Sinabi ni De Lima, dating justice secretary, na siya ay “utterly at a loss” hinggil sa basehang legal ng pagtanggi ng korte sa kanyang Omnibus Motion.

“With all due respect, the Honorable Court’s reasoning is neither here nor there in terms of applying the Supreme Court ruling in Trillanes and Jalosjos that legislators under detention are expected to have legislative output and perform the functions of their office within the physical limitation imposed upon them by the conditions of their detention,” giit niya.

“Substantially, the last word of the Supreme Court on the matter is that so long as the detained legislator is able to perform legislative functions within his or her place of detention, there is nothing in the law that prevents him or her from doing so,” dagdag ng senador.

Base sa desisyon ng korte sa pagtanggi sa ilalim ng Joint Order na may petsang June 17, 2020, inihatol ng Muntinlupa RTC 205 na kung papayagan si De Lima na lumahok sa Senate session sa pamamagitan ng teleconferencing, “would be tantamount to allowing her to participate even after the state of public health emergency.”

Aniya, lubhang nakaaalarma ang konklusyon ng desisyon ng korte na kapag pinayagan siyang lumahok sa online session at committee hearing sa pamamagitan ng teleconferencing ay walang kaibahan kung papayagan siyang dumalo nang pisikal dahil binigyan siya ng oportunidad ng bagong Senate rules na maaaring “dagdagan ang kanyang tungkuling lehislatibo” na kaya niyang magawa habang nasa loob ng kulungan.
“Again, it is clear that participation in Senate sessions and committee hearings through teleconferencing by herein Accused does not entail going out of the four corners of her detention cell or the immediate premises of the PNP Custodial Center where she is being detained,” aniya.

“Due to the wonders of modern technology and scientific advances, coupled with the Senate Rules that recognize such technology and advances, Senators can now participate in Senate sessions and committee hearings without having to be physically present at the Senate premises,” dagdag pa niya.
