Final and Executory na PERPETUAL DQ KAY PICHAY – SC

MATAPOS ang mahigit isang dekadang pagdinig ng husgado, tuluyan nang diniskwalipika ng Korte Suprema si dating Surigao del Sur Rep. Prospero Pichay kaugnay ng maanomalyang P78-milyong graft case noong panahong siya pa ang chairman ng Local Water Utilities Administration.

Sa dalawang pahinang Entry of Judgment na pirmado ni SC Deputy Clerk of Court at Chief Judicial Records Officer Basilia Ringol, kinatigan ng Kataas-taasang Hukuman ang resolusyon inilabas ng Office of the Ombudsman na una nang nanindigan tablahin ang dating kongresista sa anomang posisyon sa gobyerno.

Ayon kay Ringol, “final and executory” na ang perpetual disqualification kay Pichay.

Ibinasura rin ng Korte Suprema sa ipinalabas na GR No. 236288 (Pichay Jr. vs. Sandiganbayan Fourth Division), ang iba pang petisyong inihain ng kampo ng dating LWUA chairman.

“Wherefore, the consolidated petitions are DENIED. The decision dated October 23,2013 and the Resolution dated February 24,2014 rendered by the Court of Appeals in CA – G.R. SP 127341, subject of the petition in G.R. 211515, and Resolutions dated October 18,2016 and November 17,2017 rendered by the Sandiganbayan in SB-16-CRM-0425, SB-16-CRM-0426, SB-16-CRM-0427 and SB-16-CRM-0432 subject of the petition in G.R 236288 are AFFIRMED.”

“And that the same has on August 17,2022 become final and executory and is hereby recorded in the Book of Entries and Judgment.”

Sa ilalim ng umiiral na reglamento ng husgado, wala nang habol pa si Pichay sa sandaling lumabas ang Entry of Judgment na mabibilang na sa mga talaan ng “legal precedents” na magsisilbing gabay ng mga hukom sa pagpapasya para sa mga kahalintulad na kaso.

Bago pa man inilabas ng Korte Suprema ang Entry of Judgment sa kaso ng dating kongresista, una nang hinatulan ng Sandiganbayan Fourth Division si Pichay at ang noo’y LWUA deputy administrator Wilfredo Feleo Jr. ng anim hanggang 10 taong pagkabilanggo sa bawat isa sa three counts ng kasong graft.

Kinatigan din ng Korte Suprema ang resolusyon ng Ombudsman na nagpataw ng perpetual disqualification, kanselasyon ng “government eligibility” at “retirement benefits” ni Pichay. Paliwanag ng mga mahistrado, saklaw ng mandato ng Ombudsman ang mga mekanismong administratibo sa hanay ng mga taong-gobyerno.

Sa pagbasura ng petisyon ni Pichay — “There was no sufficient justification to warrant the reversal of its earlier ruling even as the Ombudsman said Pichay and three other LWUA officials approved the deal without any memorandum of agreement and without any authority from the Monetary Board of the Bangko Sentral ng Pilipinas and the Department of Finance.”

Nag-ugat ang kaso matapos bilhin ng LWUA (na noo’y pinamumunuan ni Pichay) ang 60% shares ng Express Savings Bank Inc. (ESBI) sa halagang P80 milyon nang walang pahintulot mula sa Monetary Board (MB).

Bukod sa nasabing transaksyon, kinuwestyon din ang paglalagak ng LWUA ng P700 milyon sa ESBI na hindi dumaan sa MB.

“The claim of both accused that there has been tacit approval by the Monetary Board on the purchase of 60 percent of ESBI’s shares as borne out of the exchanges of correspondence doesn’t have a legal anchor on the face of the particular provision of the law,” saad sa isang bahagi ng desisyon.

“The evil sought to be prevented by the stringent application of banking laws would not have transpired had the accused simply complied with what is incumbent upon them i.e., to secure prior approval with the appropriate government agency before venturing into risky purchase of 60 percent voting equity of ESBI, capital infusion and additional deposit involving the total amount of P780 million of public fund,”

Walang anomang pwesto sa pamahalaan si Pichay matapos talunin sa kanyang reelection bid ni dating partylist Rep. Romeo Momo.
