Sa pagbasura sa electoral protest laban sa ‘malawakang pandaraya’ ng kampo ni Robredo BOSES NG PINOY BINALEWALA NG PET – MARCOS

PAGBALEWALA sa boses ng mamamayang Pilipino hinggil sa tunay nilang inihalal sa posisyong bise presidente ng bansa noong 2016 ang tuluyang pagbasura ng Korte Suprema sa protestang elektoral ni dating Senador Ferdinand “Bongbong” Marcos Jr.

Ito ang pahayag ng kampo ng dating senador dahil higit umanong pinahalagahan ng korte ang usapin ng “rule” (alituntunin) upang tapusin ang kanyang protestang elektoral laban kay Maria Leonor “Leni” Robredo.

Partikular na binatikos ni Marcos ang “justice-in-charge” at “ponente” ng protesta na si Associate Justice Marvic Leonen dahil hindi nito kinilala at tinanggap ang mga ebidensya hinggil sa malawakang dayaan sa eleksyon sa Lanao del Sur, Basilan at Maguindanao.

Ang nasabing tatlong lalawigan ay siyang mga lugar na laman ng ikatlong aksyon ng protestang elektoral ni BBM.

Ang ikatlong aksyon ni Marcos ay “annulment of votes” sa nabanggit na mga lalawigan.

Pinagdudahan at kinuwestyon ni Marcos o BBM, sa Korte Suprema na tumayo bilang Presidential Electoral Tribunal (PET), ang malawakang pandaraya ng kampo ni Robredo sa nasabing mga lalawigan.

“I read the 92 – page Decision penned by Justice [Marvic] Leonen and it is unfortunate that he dismissed my election case without even allowing us to present proof about the massive cheating that occurred in Mindanao. In effect, what was supposed to be a separate, distinct and independent cause of action was rejected because of a plethora of rules. Indeed, it is regrettable that the Justice-in-charge viewed the case with extreme partiality through his yellow lenses,” hagupit ni BBM.

Nakasaad sa desisyong isinulat ni Leonen na hindi tinanggap ng PET ang ikatlong aksyon ni Marcos dahil sapat na ang naunang resulta ng muling pagbibilang ng mga resulta ng mga boto sa Camarines Sur, Iloilo at Negros Oriental.

Sa isinagawang recount, nadagdagan pa ng 15,093 ang mga boto laban kay Marcos.

Ang orihinal na lamang ni Robredo kay Marcos, batay sa Commission on Elections (Comelec), ay umabot sa 263,473.

Nanindigan si Leonen na sapat na ito upang ibasura ang kahilingan ni Marcos na magsagawa ng imbestigasyon ang PET sa halalang isinagawa sa Lanao del Sur, Basilan at Maguidanao.

Inihayag ni Marcos na mayroon siyang sapat at matibay na mga ebidensiyang magpapatotoo sa reklamong malawakang dayaang ikinasa ng kampo ni Robredo upang manalo ito sa halalang 2016.

Mayroong tatlong mahistrado, kabilang na si Chief Justice Diosdado Peralta (lumahok pa rin sa desisyon bago magretiro noong Marso 27), na legal ang pagbalewala sa mga boto sa Lanao de Sur, Basilan at Maguindanao alinsunod sa umiiral na desisyon ng Korte Suprema sa kasong Harlin Abayon vs. Raul Daza hinggil sa eleksyong 2013 kung mapatunayang malaganap ang dayaan.

Banggit ni Peralta kung mahigit 50% ang kuwestyonableng balota ay puwedeng balewalain, o ipawalang bisa ang mga boto, alinsunod sa konseptong “annulment of votes” na siyang nakasaad sa Election Law.

Ngunit, hindi ito nangangahulugang “failure of election” dahil magkaiba ang kahulugan ng naturang dalawang konsepto, batay sa Election Law ng bansa.

Matagal nang kinikilala at madalas gamitin ng Comelec ang pagkakaiba ng mga konsepto ng annulment of votes at failure of election.

Naniniwala si Peralta at iba pang mahistrado na ibang kaso ang reklamo ni BBM sa Lanao del Sur, Basilan at Maguindanao at iba rin ang aksiyon niya sa Camarines Sur, Iloilo at Negros Oriental.

Iginiit ni Leonen na walang alintuntunin para sa ikatlong reklamo ni Marcos.

Ikinatwiran pa ni Leonen na: “changing the rules this late in the game to grant protestant’s third cause of action would not be a good precedent as it would tailor the Protest in favor of one party”.

Noong Oktubre 2019, naging ponente si Leonen sa kaso makaraang magretiro ang orihinal na tagapagsulat ng desisyon ng PET para sa protestang elektoral ni Marcos.

Bago napunta kay Leonen ang kaso, mayroon nang desisyon ang PET tungkol sa Camarines Sur, Iloilo at Negros Oriental.

Mula rito, hindi na umalagwa si Leonen upang isalang at imbestigahan ng PET ang eleksyon sa Lanao del Sur, Basilan at Maguindanao.

Mistulang iginapos na ni Leonen ang kanyang isipan sa unang desisyon ng naunang ponente ng kaso, samantalang binalewala ito ng mayorya ng PET.

Ipinaliwanag ni Marcos na: “The power of PET is plenary. The third cause of action, like annulment, should not pose a problem even in the absence of rules because the will of the electorate is of paramount importance. When asked for their opinion regarding election rules, both the Commission of Elections (Comelec) and the Office of the Solicitor General (OSG) were one in saying: what is important in any election is that the will of the people is paramount”.

“The existence or non-existence of procedural rules should not be an obstacle in knowing the true will of the people. Rules are just secondary in nature. What is important is the true will of the electorate,” paliwanag pa ni Marcos.

Ayon sa dating senador, mahalaga ang boses ng mga botante dahil sa kanila magmumula ang katotohanan sa eleksyon, lalo na kung mayroong nandaya sa pagkilos na ito ng pamahalaan at mamamayan.

“The PET should do everything in its power to ascertain who really won as vice president. The truth should not be limited to the existence or non-existence of the Rules on Annulment because at the end of the day, it will be the people themselves who will be deprived of ascertaining who the real victor in the 2016 elections were,” tirada ni Marcos.

Binanatan din niya ang masamang karanasan sa PET sa ganitong pahayag: “If the PET was going to dismiss our election protest without hearing all the evidence, then why didn’t it dismiss our third cause of action from day 1? Instead they made us pay 66 million pesos for the protest . . . made us wait for almost 5 years . . . made us believe that the annulment was a separate, distinct and independent cause of action — only to decide the case without affording us due process?”

Idiniin ni Marcos na siguradong napakasamang pangyayari ang pagbasura sa kanyang protestang elektoral nang hindi inalam nang mabuti ang katotohanan sa reklamong malaganap na dayaan.

“This is a very bad precedent because in the future, no one in their right mind would dare question the results of an election. It is an expensive and time consuming exercise. So long as there is a ray of hope, I will continue to fight. I owe this to the more than 14 million loyalists who voted for me. I owe this to our youth who will be casting their ballots in 2022,” bigwas ni Marcos.

Isinusog din niya na “at the end of the day, the true will of the electorate must prevail”.
