HINDI maaapektuhan ang pagtestigo ni Ramil Madriaga sa impeachment proceeding laban kay Vice President Sara Duterte kahit may kinahaharap itong perjury case.

Ito ang pahayag ni House Committee on Justice Chairperson Gerville Luistro kasabay ng paglilinaw na hiwalay ang kasong isinampa laban kay Madriaga sa kasalukuyang impeachment proceeding.

“Ibang forum ‘yon, where the case of perjury was filed by the Vice President against Ramil Madriaga. This one is separate and distinct from the case that was filed by the Vice President,” paliwanag ni Luistro.

“Regardless of the filing of the perjury case, the Justice Committee will simply proceed with its proceedings and will receive the testimony of Ramil Madriaga the moment he is presented by the complainant,” dagdag pa nito.

Ang testimonya ni Madriaga ay itinuturing na “crucial” sa impeachment complaint laban kay Duterte.

Si Madriaga, na isang self-confessed bagman ni Duterte, ay inakusahan sa kanyang sworn statement ang Pangalawang Pangulo na tumanggap ng campaign funds mula sa mga drug lord at Philippine Offshore Gaming Operators (POGO).

Inamin din ng dating aide ni Duterte na siya ang nagdedeliver ng malaking halaga ng pera sa iba’t ibang tao sa utos umano ng Pangalawang Pangulo.

Kasalukuyang nakapiit si Madriaga sa Camp Bagong Diwa sa Taguig dahil sa pagkakasangkot sa isang kidnapping case. Gayunman, nagpahayag ito ng intensyon na dumalo sa impeachment proceeding sa Kamara.

Samantala, iimbitahan si Vice President Duterte na dumalo sa impeachment proceeding, ngunit nasa kanya ang desisyon kung dadalo o hindi, ayon kay Luistro.

“Let us understand that the presence during the hearing proper is part of her due process. In other words, the prerogative belongs to her. Whether she wants to come or not to come, that is actually her option,” ani Luistro.

Sa susunod na pagdinig, tutukuyin ng komite kung may sapat na grounds ang impeachment complaint, kung saan ihaharap ng mga complainant ang kanilang ebidensya. Kapag pumasa sa grounds ang reklamo, susunod namang pagdedesisyunan kung may probable cause.

Ayon kay Luistro, kailangan ng 28 boto mula sa 55 miyembro ng komite upang umusad ang reklamo laban kay Vice President Duterte.

“The panel is composed of 55 members, including ex-officio members, meaning at least 28 votes are needed to secure the required majority,” ani Luistro.

Samantala, kabilang din sa posibleng busisiin ng panel ang bank records ni Duterte. Ipinaliwanag ni Luistro na sa impeachment proceedings ay may exception ang Bank Secrecy Law.

“As a general rule, the Bank Secrecy Law protects the confidentiality of all bank records. However, there is an exception — the impeachment proceedings or impeachment cases,” aniya.

Magpapalabas umano ang komite ng subpoena duces tecum upang obligahin ang mga bangko na isumite ang kaukulang bank documents.

Nilinaw ni Luistro na ang mga hakbang na ito ay kinakailangan pang pagbotohan ng komite.

Ang pagpapatuloy ng impeachment proceeding ay inaasahang gaganapin sa ikalawang linggo ng Abril, matapos ang Holy Week, upang mabigyan ng panahon ang magkabilang panig na magsumite ng kanilang mga sagot at ebidensya sa kaso.
