HINDI ganap ang hustisya kung mananatiling malaya at banta sa kaligtasan ng marami ang 83 iba pang sangkot sa pamamaslang sa 58 katao – kabilang ang 32 mamamahayag sa bayan ng Ampatuan sa lalawigan ng Maguindanao, noong Nobyembre 23, 2009.

Sa paggunita ng ika-13 anibersaryo, nanawagan ang National Union of Journalists of the Philippines sa pamahalaan na tugisin at panagutin ang iba pang may kinalaman sa tinaguriang “deadliest attack on journalists” sa buong mundo.

“We note as well that it is also almost three years since the families of the victims received partial justice through the conviction of 28 people, including masterminds Datu Andal Jr and Zaldy Ampatuan, for 57 counts of murder. Fifteen other people were convicted as accessories to the murders,” ayon sa NUJP.

“Kung seryoso ang palasyo, dapat magbuo ito ng tracker team para tugisin ang 83 suspects,” ayon naman sa Facebook post ni Sonny Fernandez ng NUJP.

Nanawagan din ng kasapian ng mga mamamahayag sa Court of Appeals – paspasan ang pagrerebisa sa inihaing apela ng pamilya Ampatuan.

“Since the decision in 2019, Andal Jr. and Zaldy have brought the conviction to the Court of Appeals. While this is within their rights and is part of court processes, this also means the families face a longer wait for full justice as well as for compensation for the loved ones they lost on November 23, 2009.”

Hiniling din ng NUJP na isama sa talaan ng mga biktima si Reynaldo Momay, na anila’y kasamang namatay ng iba pang peryodista. Katunayan anila, kumpirmadong kay Momay ang pustisong nakuha sa lugar ng insidente.

“Part of that call for justice is the recognition that there were 58 victims of the massacre and that the trial should include the murder of Reynaldo Momay, whose dentures were found at the massacre site and who was confirmed to have joined the coverage on November 23, 2009.”

Sa rekord ng korte, 44 lang sa 200 na akusado ang nahatulan. Ang iba ay nananatiling nasa laya. Mayroon din ilang pumanaw bago pa man lumabas ang hatol ng korte taong 2019 – kabilang ang nakatatandang Ampatuan na si Datu Andal Sr. na namatay sa bilangguan.

EO Ni GMA Bawiin

Samantala, kailangan umanong bawiin o ibasura ni Pangulong Ferdinand Marcos Jr. ang Executive Order (EO) 546 na inisyu ni dating Pangulong Gloria Macapagal Arroyo upang hindi na maulit ang Ampatuan Massacre.

Sa ika-13 taong anibersaryo ng Ampatuan massacre kahapon (November 23), inihayag ni dating Bayan Muna party-list Rep. Carlos Zarate na hindi malayong mangyari sa ilalim ng Marcos Jr. administration ang Ampatuan massacre hangga’t hindi binabawi ang nasabing executive order ni Arroyo.

“Executive Order 546, issued during the time of former Pres. Gloria Arroyo, allows politicians to form their own militias and  the creation of paramilitary units in the guise of counter-insurgency operations,” ani Zarate.

Isinisisi umano ng mga human rights group sa nasabing EO ang patuloy na paglala ng paglabag sa karapatan pantao kaya dapat itong bawiin ni Marcos Jr.

“Until now, we are still confronted regularly with more violence and human rights violations, many committed by these private armies or paramilitary groups  – a grim reminder that impunity still reigns,” ayon pa sa dating mambabatas.

Naniniwala rin si Zarate na kapag tuluyang ibinasura ang nasabing EO ay tuluyang makakamit ng pamilya ng mga biktima sa Ampatuan, Maguindanao massacre ang katarungan.
“There will never be genuine justice to the victims for as long as that executive order that emboldened and empowered the Ampatuan clan to slaughter 58  Filipinos, including 32 journalists, in Ampatuan town, Maguindanao is still very much part of the government’s  arsenal of repression,” dagdag pa ni Zarate.
