ANTI-CHILD PORNOGRAPHY PALALAKASIN NI NOGRALES

UPANG mapalakas ang kampanya laban sa child pornography, inihain ni Rizal 2nd District Congressman Fidel Nograles ang panukalang Anti-Child Pornography Act of 2009 o Republic Act (RA) 9775.

Sa kanyang House Bill (HB) 7633 o Anti-Sexual Abuse and Exploitation of Children Act of 2020, nais ni Nograles na amyendahan ang Section 9 ng RA 9775 dahil ito ang dahilan kung bakit hindi maharang ng Philippine Chamber of Telecom Operators ang child pornography sa websites.

“This is an urgent issue that Congress must immediately address, and comes on the heels of reports of an unprecedented number of abuse cases during the ongoing pandemic,” ani Nograles.

Sa ilalim ng Section 9 ng RA 9775, pinapayagan ang mga internet service providers (ISP) na mag-install ng software para hindi maka-access at hindi maipasa ang child pornography sa website.

Inaatasan din ang mga ISP na ipaalam sa mga otoridad sa loob ng pitong araw ang kanilang na-detect na internet address na maaaring naglalaman ng mga child pornopgraphy materials.

“However, the same provision also states that “nothing in this section may be construed to require an ISP to engage in the monitoring of any user, subscriber or customer or the content of any communication of any such person,” ani Nograles.

“Naniniwala tayong this simple amendment would go a long way in empowering our ICTSPs who are key partners in our anti-child pornography campaign so that they can nip instances of abuse at the bud,” dagdag ng Harvard-trained lawyer.

Dahil dito, kailangang amyendahan umano ang nasabing batas partikular na ang Section 9 at ilalagay ang mga katagang “Duties of Information and Communication Technology Service Providers (ICTSP). – All Information and Communication Technology Service Providers (ICTSP) shall install available technology, program or software to ensure that access to or transmittal of any form of child pornography will be blocked or filtered”.

Lahat din ng ICTSP ay kailangang ipaalam sa Philippine National Police (PNP) o sa National Bureau of Investigation (NBI) sa loob ng 7 araw ang mga natuklasan nilang mga child pornography material sa mga internet user.

“All ICTSP shall maintain the privacy of the data captured relevant to this section while complying with notification requirements of this section. Provided, That no ISP shall be held civilly liable for damages on account of any notice given in good faith in compliance with this section. Provided further that the data captured solely for complying to this Section shall be exempt from the application of the Data Privacy Act,” ayon pa sa mga amendment na ipinanukala ni Nograles.

Bukod dito, hindi na papapasukin ang mga dayuhan sa Pilipinas na sangkot sa sex-related offenses upang maproteksyuhan, hindi lamang ang mga kabataan na maaari nilang maging biktima habang sila’y namamalagi sa bansa.
“Nananawagan ako sa mga kapwa kong mambabatas na i-prioritize natin ang pagpasa ng panukalang-batas na ito.

We need to do more to protect our children from abuse,” ayon pa kay Nograles. (BERNARD TAGUINOD)
