TINIYAK ni Bureau of Customs (BOC) Commissioner Rey Leonardo Guerrero na tuluy-tuloy na ang reporma sa ahensiya matapos ipag-utos ni Pangulong Rodrigo Duterte na tanggalin ang humahadlang sa pagbabago.

Ang sinibak ay ang mismong chief of staff (COS) ni Guerrero na si Atty. Teodoro Jumamil.

Minura pa ito ni Duterte nitong Agosto 24 dahil sa kinasasangkutan umano nitong katiwalian at korapsyon.

Bilang panimula ng reporma, ikinasa ni Guerrero ang “no face to face transaction” upang isagawa ang pagbabayad sa BOC, sa pamamagitan ng serbisyong online.

Ipinatigil din ni Guerrero ang direktang pagkontak, o pag-uusap ng brokers at mga kawani ng BOC.

Sa ganitong paraan, kumbinsido si Guerrero na mapipigilan ang korapsyon sa BOC.

Alam ni Guerrero na kanyang aksiyon ay mabagsik na siguradong ikagagalit ng mga “players” at “smugglers” sa BOC, ngunit itinuloy niya ito upang malinis ang ahensiya mula sa malaganap at garapalang korapsyon.

Sa matagal na panahon, isang bukas na liham ang gawain ng ismaglers sa BOC na ibaba ang halaga ng kanilang mga produktong ipapasok sa bansa upang maiwasan ang tinatawag na “bidding and packaging for the cost of brokerage and logistics of shipments.”

Ikinatuwa naman ng import and export industry stakeholders ang mga pagbabagong itinutulak ngayon ni Guerrero na kung hindi man anila tuluyang mabura ay siguradong mababawasan ang korapsyon sa ahensya.

Ang kalakaran sa BOC ay “if you package deal the cost of duties through bidding, the invoice must be falsified.

The brokers and importers also use the word “transaction value,” paliwanag pa ng mga stakeholder.

Ngunit, ang idineklara sa invoice, o pekeng invoice ay hindi dapat “upgraded as per World Trade Organization agreement.”

Ayon sa mga ito, “The tariff rates are known and fixed and the importers know the real amount of the imported goods.

There is no need for bidding because all you have to do is to multiply the invoice price with the tariff rate in order to know how much duties and taxes to pay.

When you look for the broker with the lowest quotation, you are looking for the broker who has the guts to undervalue and falsify the invoice.

The falsified invoice will further be falsified and lowered by other brokers in order to get the client. And so on until the duties and taxes are very low already.”

“Why? This is due to the fact that Filipinos live to buy the cheapest products.

Due to the competition, the importers will undervalue in order to corner the supply agreement. Even legitimate manufacturers would seek for the lowest bidder/broker/supplier in order to be competitive. This system makes the BOC a problematic agency.

The truth is, it takes two to tango but the blame is always on the corrupt customs.

How about the buyers who want the cheapest product and the traders who want to import even to the point of falsifying the invoice just to earn,” patuloy ng mga stakeholder.

Nahihirapang kumilos ang ismaglers sa repormang ginagawa ni Guerrero.

Ayon sa sources sa BOC, P40,000 lang ang ‘hatag’ sa tinatawag na 1 x 40 duties at buwis noong panahon ni datng Commissioner Nicanor Faeldon.

Ngayon ay P120,000 ang pinakamababa na nangangahulugang tatlong beses tumaas ang presyo.

Ang mga bayarin ay inaasahang tataas pa kapag natuloy ang implementasyon ng “full automation,” “face to face transaction” at iba pang repormang isinulong ni Guerrero.

Inilarga rin ni Guerrero ang “dashboard” kung saan ang mga opisyal at kolektor ng BOC ay bibigyan ng eksakto at totoong datos para sa “monitoring purposes.”

Ang mga tinanggal ni Guerrero na kalakaran sa BOC ay siyang ginamit upang matanggal ang mga naunang commissioner ng ahensiya.

Ngayon, inaasahang maghuhuramentado ang mga ismagler at mandarambong sa BOC kay Guerrero.

Ngunit, kailangang gawin din ng Bureau of Internal Revenue (BIR) ang papel nito sa pagkahon at pagsukol sa mga pekeng importers at suppliers upang tuluyang magtagumpay ang mga desisyon at aksyon ni Guerrero.

Nitong Lunes lang, naglabas ng galit si Pangulong Duterte laban kay Jumamil.

Hindi umano niya maaaring balewalain ang ginagawa ni Jumamil kahit pa sabihin na sinuportahan siya nito noong 2016 presidential campaign.

Tinukoy rin ng Chief Executive kung paanong nagkaroon ng dalawang posisyon si Jumamil. Isa sa Bureau of Customs at sa Development Bank of the Philippines.

“I have to name him publicly for being….putang ina, balasubas ka eh,” diing pahayag ni Pangulong Duterte.

Inulit naman ng Punong Ehekutibo na may tiwala siya kay Guerrero na naging hepe ng Customs simula 2018.
