IKINASA kahapon ang Hakbang ng MAISUG Prayer Rally sa Davao del Norte tulad ng inanunsyo ng kampo ni dating Pangulong Rodrigo Duterte at ng sinuspindeng si Davao del Norte Governor Edwin Jubahib.

Sa kanyang naunang pahayag, sinabi ni Gov. Jubahib na higit 100 thousand katao ang inaasahan nilang makikiisa sa rally kasunod ng nangyayaring ‘oppresion’ umano sa kanya.

Kahapon ay maagang nagtungo sa DavNor Sports and Tourism Complex, sa Mankilam, Tagum City ang mga pulis para matiyak ang seguridad sa inaasahang pagdagsa ng mga lalahok sa prayer rally.

Sa pag-alis sa tungkulin kay Jubahib ay muling pinatutsadahan ni Duterte si Pangulong Ferdinand Marcos Jr.

Aniya, pinapakita ni Marcos ang pagiging authoritarian sa aksyon kay Jubahib.

Si Jubahib ay nahaharap sa 60 araw na suspension order base sa utos ng Department of the Interior and Local Government (DILG) na pinirmahan ni Executive Secretary Lucas Bersamin.

Ani Duterte, hindi na sinusunod ni Marcos Jr. ang demokrasya ng bansa.

Mistulang pinaalalahan din niya si Marcos na si Jubahib ay binoto at iniluklok sa puwesto ng taumbayan kaya’t hindi tama na basta na lang itong patalsikin sa puwesto.

Paglabag sa Batas ni Bersamin

Samantala, inakusahan naman ni Cong. Pantaleon Alvarez si Executive Secretary Lucas Bersamin na nilabag ang batas nang pirmahan nito ang direktibang nag-uutos na bakantehin na ni Jubahib ang kanyang posisyon.

“Kahit walang basehan, binigyan ng order of suspension si Gov. Edwin Jubahib. Nung nakita ko ‘yung order, sabi ko I was disappointed, why? Because the order was signed by a former chief justice, itong si Bersamin sabi ko former chief justice ito dapat he should be the one to respect ‘yung due process at equal protection of the law, malinaw sa Saligang Batas ‘yan di ba?,” sabi ni Alvarez.

Sumunod sa Due Process

Bilang tugon, iginiit ni Executive Secretary Lucas Bersamin na walang paglabag sa karapatan dahil may “due process” matapos nitong ipag-utos ang preventive suspension laban kay Jubahib.

Si Jubahib ay sinuspinde sa gitna ng reklamo ng di umano’y “misuse of authority, potential oppression, and the utilization of government funds to advance the interests of a private company.”

“The issuance of the preventive suspension did not violate Gov. Jubahib’s right to due process. Firstly, this office ordered the respondent’s suspension to prevent any undue interference in the conduct of the investigation,” ayon kay Bersamin sa isang kalatas.

“Secondly, the preventive suspension of Gov. Jubahib was ordered only after the issues were joined in accordance with Section 63 (a) of Republic Act No. 7160 and Sections 1 and 4, Rule 6 of Administrative Order No. 23 series of 1992,” dagdag na pahayag ni Bersamin.

Itinalaga si Vice Governor Oyo Uy bilang officer-in-charge (OIC) para sa 60 araw subalit nakatakda namang maghain ng petisyon si Jubahib para sa temporary restraining order (TRO) sa Korte Suprema.
