“HANDS off lawyers and matters of the court.”

Ito ang mensahe ni Rizal 2nd district Congressman Fidel Nograles sa Philippine National Police matapos mag-request ang isang intelligence officer sa Calbayog City, Samar sa korte ng listahan ng mga abogado na nagtatanggol sa mga miyembro umano ng communist terrorist group (CTG).

Para sa mambabatas, foul ang ginagawang ito ng PNP sa mga abogado na ang tungkulin ay ipagtanggol ang sinomang tao, anoman ang katayuan at idelohiya ng mga ito sa buhay.

“Last I checked lawyering is not a crime, regardless of who you represent. Lawyers must not be targeted for upholding constitutionally and universally guaranteed rights,” ani Nograles na isang Harvard-trained lawyer.

Bagama’t sinibak na sa serbisyo ang police officer na nag-request ng listahan ng mga abogado na nagtatanggol sa mga miyembro umano ng CTG na si Police Lt. Fernando G. Calabria Jr., kailangan aniya ng konkretong aksyon dito ng Department of Interior and Local Government (DILG) at Philippine National Polcie (PNP).

Isa si Nograles sa patuloy na nananawagan sa DILG at PNP na proteksyunan ang mga law practioner dahil sa nakalipas na halos 5 taon ay umaabot na sa 56 abogado, prosecutor at huwes ang napatay.

“The police has no business meddling with affairs of the court. We cannot condone this overreach by the Calbayog City police, which undermines the administration of justice through intimidation, hidden behind the veil of courtesy and pseudo-legality,” ani Nograles, vice chairman ng House committee on justice.

Binalaan din nito ang lahat ng law enforcerment agencies na huwag payagan ang mga ganitong request bilang standard procedures at hinamon din nito ang PNP na magsalita kung mayroon silang ganitong kautusan dahil isinangkalan ni Calabria ang PNP higher office sa pagre-request ng listahan ng mga abogado.

“I urge our DILG and PNP leadership to quickly dispel this mistaken notion that police stations have the authority to ask for such lists. In a climate where lawyers are put to the sword regularly without anyone being punished, it sends a message that those who choose to defend those who are out of favor will be under close watch simply for upholding their oaths as lawyers,” ayon pa sa mambabatas.

Nangangamba ang mambabatas sa ginagawang ito ng PNP dahil kamakailan lamang ay inatake at sinaksak sa ulo si Atty. Angelo Karlo “AK” Guillen sa Iloilo City na na-red tag dahil siya ang abogado sa petisyon na inihain ng Bagong Alyansang Makabayan (Bayan) laban sa implementasyon ng Anti-Terrorism Act sa Korte Suprema.
