‘GUILTY’ ang naging hatol ng Office of the Ombudsman sa kasong katiwalian laban kay Nueva Ecija Governor Aurelio Umali na may kinalaman sa irregular na pag-isyu nito ng 205 quarry permits na walang Environmental Compliance Certificate (ECC) mula sa Department of Environment and Natural Resources (DENR) noong 2014 hanggang 2016.

Sa inilabas na hatol ng Ombudsman, si Umali ay napatunayang lumabag sa Section 25(2) ng Republic Act 6770, OMB Act of 1989, at Section 10(b), Rule III ng Administrative Order No. 7 ng Rules of Procedure ng graft court, kaya sinuspinde ito ng isang taon na walang suweldo.

Ang kaso ay nag-ugat sa isinampang reklamo ni Roberto M. Duldulao sa Ombudsman kung saan ibinunyag nito ang pag-‘hokus-pokus’ aniya ni Umali sa 205 Commercial Sand and Gravel Permits (CSGPs) na ibinigay sa mga hindi kwalipikadong haulers at walang ECC mula sa Mines and Geosciences Bureau ng DENR.

“There is a basis to hold Aurelio Umali administratively liable. He was remiss in his duty to ensure the enforcement and compliance with all laws, rules and regulations within his jurisdiction,” ayon sa desisyon ng Ombudsman.

Ang hatol kay Umali ay base sa rekomendasyon na isinumite ni Graft Investigation and Prosecution Officer III Leilani P. Tagulao-Marquez sa opisina ni Assistant Ombudsman Pilarita T. Lapitan at inaprubahan naman ni Ombudsman Samuel R. Martires sa pamamagitan ni Deputy Ombudsman Dante F. Vargas.

“While Gov. Aurelio Umali’s act of issuing the CSGPs from 2014 to 2016 was neither motivated by a premeditated, obstinate, or intentional purpose, his acts still sufficiently constitute the offenses of Conduct Prejudicial to the Best Interest of the Service and Simple Misconduct,” giit pa sa desisyon.

Bukod sa ilegal na pag-iisyu ng quarry permits, iginiit din ng Ombudsman na sumablay ang provincial government sa pamumuno ni Umali na mag-remit ng tamang koleksyon para sa nakukuhang buwis sa quarry.

Base sa desisyon ng OMB, hindi katanggap-tanggap ang idineklarang quarry collection ng Kapitolyo ng Nueva Ecija noong 2014 hanggang 2016.

Lumabas din kamakailan sa ulat ng Commission on Audit (COA) na kulelat sa quarry collection ang Nueva Ecija kung saan umabot lamang sa halos P400,000 ang idineklarang kita ng probinsya noong 2022 at nasa P1M lamang ang kinita noong 2023. Malayong-malayo umano ito sa projection ng paniningil ng buwis sa quarry.
