KWESTYONABLE ang pagiging Pilipino ng mga Tulfo kaya hindi sila nararapat maluklok sa pwesto.

Kabilang ito sa mga dahilan ng paghahain ng disqualification case ng isang abogado kamakalawa laban sa mga Tulfo na tumatakbo sa Kongreso para sa Halalan 2025.

Sa 19 pahinang petisyon na inihain ni Atty. Virgilio Garcia sa Commission on Elections (Comelec), hiniling na idiskwalipika sina ACT-CIS Rep. Erwin Tulfo at broadcast journalist Ben Tulfo, na parehong tumatakbo sa Senado; ACT-CIS Rep. Jocelyn Pua-Tulfo at Quezon City Rep. Ralph Tulfo, na nagbabalik sa Kamara, at dating Tourism secretary Wanda Tulfo Teo na nominado naman ng Turismo party-list.

Sina Erwin, Ben at Wanda ay magkakapatid, habang sina Jocelyn at Ralph ay maybahay at anak ng isa pang kapatid ng mga Tulfo na si Raffy na kasalukuyang senador.

Sa kanyang petisyon, sinabi ng petitioner na ang mga Tulfo ay bumubuo ng political dynasty na ipinagbabawal sa ilalim ng 1987 Constitution at hindi natural-born Filipinos.

“They are within the first and second civil degree of consanguinity or of affinity of each other,” saad sa petisyon.

“There is already an existing anomalous scandalous father, mother, son in congress and this family want to add three more making a total of seven of them, all in same Congress. That is clearly a concentration of political power in one family,” sabi ni Garcia.

Binigyang-diin din sa reklamo na hindi natural born Filipinos ang mga Tulfo.

“The Constitutional requirement of a natural-born citizen is an express qualification and must be complied with strictly by all candidates. Suffice it to state that lacking in this requirement will not qualify any aspirant to join the race, in other words, to stress this point,k he or she is not a candidate,” pahayag ni Garcia na isa ring retiradong Brig. General.

Paliwanag niya, sa muling pagkakaroon ng Philippine citizenship, ang mga bumabalik na Pilipino sa ilalim ng RA 9225 ay hindi nangangahulugan ng pagbabalik ng kanilang natural born status.

“Once a natural-born citizen renounces his/her Philippine citizenship, he/she becomes an alien. To reacquire Philippine citizenship, he/she must go through naturalization proceedings just like any other alien,” paliwanag pa nito.

“Respondents resided in the United States for quite a long while. They must show to the satisfaction of this Commission that indeed, they have all the qualifications required by the Constitution and none for the disqualification by law.”

Wala pang komento ang mga Tulfo hinggil dito at hindi pa umano natatanggap ang reklamo laban sa kanila.

Samantala, sinabi ni Comelec Chairman George Garcia na sasailalim ito sa karaniwan at ordinaryong proseso na itatalaga sa isang dibisyon ng Comelec.
