ITINANGGI ni Quezon City Mayor Joy Belmonte nitong Lunes ang lumabas na ulat na tahasang aarestuhin ng city government ang mga taong lalabag sa health protocols.

Kasabay nito, humingi ng paumanhin ang alkalde sa idinulot na kalituhan at pagkaalarma sa ipinalabas niyang memorandum kung saan nakasulat ang ‘guidelines’ hinggil sa ipatutupad na warrantless arrest sa quarantine violators.

Nagpalabas si Belmonte ng paglilinaw bunsod ng online group exchanges na aniya’y nag-demonized sa nasabing guidelines.

“I’m aware that there was a massive Viber group exchange in which the guidelines were demonized, it was alarmist in a sense. The intention was to show that the memorandum was an excuse for the local government to carry out abuse of power and  to do indiscriminate arrest and of course for me that is misinformation,” pahayag niya sa panayam ng ABS-CBN News Channel.

“We exercise maximum tolerance. We exercise the law based on reason and common sense. We are not out to indiscriminately arrest people just because we want to show we are powerful, we are not that kind of government,” dagdag niya.

Ipinunto ni Belmonte na ang layunin ng nasabing guidelines ay ipatupad ang “standard, lawful and proper guidelines that can be followed by all law enforcers.”

“Really the intent of this is precisely to prevent abuse of power,” aniya pa.
“I’m sorry if they cause so much misunderstanding or apprehension and they alarm a lot of people,” dagdag pa ng alkalde.

Nauna rito, naalarma ang mga residente ng lungsod makaraang ipalabas ng Office of the Mayor ang guidelines hinggil sa umano’y ipatutupad na warrantless arrest.

Ang memorandum na ipinalabas ng Office of the Mayor  na pirmado ni Mayor Joy Belmonte, may petsang Huly 13, 2020, ay naka-address sa lahat ng Punong Barangay, District Director and Police Station Commanders, Quezon City Police District (QCPD), chairmen at members, Quezon City Incident Command System-Law and Order Cluster; Head, Barangay and Community Relations Department (BCRD); Head, Social Services and Development Department (SSDD),   Head, Quezon City Health Department (QCHD), Director, Quezon City General Hospital; Novaliches District Hospital; Director, Rosario Maclang Bautista Hospital; OIC, Public Affairs and Information Services Department (PAISD) at lahat ng concerned.

Nakapaloob sa subject ng nasabing memorandum, ang ‘guidelines on the warrantless apprehension and arrest of violators of quarantine measures within the territorial jurisdiction of Quezon City during the periods of general community quarantine (GCQ) and modified general community quarantine (MGCQ).’

Batay pa sa background ng memo, ito raw ay dahil sa pagtaas ng mga kaso ng COVID-19 sa lungsod at sunod-sunod na pagbaba ng ‘community quarantine classification’ na pangtakip sa National Capital Region (NCR) na may kaugnayan sa resolusyon na inisyu ng Inter-Agency Task Force (IATF) for the Management of Emerging and Infectious Diseases.

Nakapaloob din sa memo na kailangang iimplementa ang mas pinahigpit na quarantine measures para mapigilan ang ang mass gatherings, maipatupad ang social distancing, pagsusuot ng face masks at iba pa sa lungsod.

Batay sa Section 10 ng memorandum, ang sinumang mapapatunayan na lumabag sa Section 9 ay papatawan ng multa na hindi bababa sa P20,000 ngunit hindi lalagpas sa P50,000. At pagkakakulong na hindi bababa sa isang buwan at hindi lalagpas ng anim na buwan.

Binanggit pa sa memo na ang sinumang magpapatupad ng warrantless arrest ay kailangan munang ipaalam sa kanilang aarestuhin ang kanilang nilabag at dapat basahan ng Miranda Rights ang suspek.

Nakatala rin sa memorandum na may priority lane sa Quezon City General Hospital, Rosario Maclang Bautista Hospital ang mga kaso na nakapaloob sa memo.

Ang Desk Officer na nakatalaga bilang Investigator-On-Case (IOC) ang magsisimula ng kaukulang imbestigasyon. Ang kukuha naman ng statement o affidavit ay ang arresting officer.

Tatanungin din ng IOC ang suspek kung may abogado siya o wala, kung wala ay magkakaroon ng video conference o communication para sa paghahanda sa kanyang request para sa Public Attorney’s Office (PAO). (JOEL O. AMONGO)
