KUKUWESTYUNIN sa Korte Suprema ang 2024 General Appropriations Act (GAA) o 2024 national budget na nagkakahalaga ng P5.678 trillion matapos mabigo si Pangulong Ferdinand “Bongbong” Marcos Jr., na i-veto ang P449.5 billion unprogrammed appropriations na isiningit sa Bicameral conference committee.

Ayon sa abogadong si Albay Rep. Edcel Lagman, kailangang kuwestiyonin sa Kataas-taasang Hukuman ang nasabing batas matapos mabigo si Marcos na burahin ang isiningit ng mga kinatawan ng Senado at Kamara sa Bicam.

“The President’s utter failure to veto the excess items aggravates the constitutional defect,” ani Lagman. Hindi naman nito nilinaw kung kasama siya sa mga maghahain ng petisyon para ideklarang unconstitutional ang 2024 national budget.

Bago ang Bicameral conference committee na binubuo ng 12 senador at 12 congressmen ay P281.9 billion lamang ang unprogrammed appropriations subalit dinagdagan ito ng P449.5 billion.

Labag aniya ito sa Section 25 (1) ng Article VI ng 1987 Constitution na nagsasabing hindi dapat dagdagan ng Kongreso ang pondo na inirekomenda ng Pangulo para sa operasyon ng gobyerno sa buong taon.

“The prohibition on the Congress from increasing the appropriations recommended by the President covers both the programmed appropriations, which have available budget sources, and the unprogrammed appropriations, which have only contingent budget sources limited to (a) release of new loan proceeds for foreign assisted projects; (b) revenue collections from new tax laws; and (c) increase in non-tax revenue collections over target,” paliwanag pa ni Lagman.

Nangangamba rin ang mambabatas na maraming proyekto ng gobyerno ang maisasakripisyo para mapondohan ang pet projects ng mga kaalyado ng Pangulo na ipapasok sa unprogramed appropriations.
