ISINAMPA kahapon sa mababang kapulungan ng Kongreso ang impeachment complaint laban kay Supreme Court (SC) Associate Justice Mario Victor F. Leonen.

Pormal na inihain ni Edwin M. Cordevilla, FLAG-Maharlika Secretary-General, ang 40 pahinang Verified Complaint for Impeachment laban kay Leonen na isa sa mga appointee ni dating Pangulong Benigno “Noynoy” Aquino III sa Korte Suprema. Sinamahan si Cordevilla ng kanyang legal counsel na si Atty. Larry Gadon.

Agad namang inendorso ni Ilocos Norte Rep. Angelo Marcos Barba ang Impeachment complaint ni Cordevilla, kaya otomatikong ipapasa ito sa House justice committee para dinggin at kung umabot sa 1/3 o 101 sa mga miyembro ng Kamara ang mag-eendorso sa susunod na araw ay agad ibibigay ang article of impeachment sa Impeachment court.

“Whereas, I have examined the afformention verified complaint and found the same to be sufficient in form and substance,” ayon sa resolution of endorsement na inihain ni Marcos-Barba.

Nakasaad sa reklamo ni Cordevilla ang culpable violation of the constitution at betrayal of public trust laban kay Leonen na kapag umakyat ang kaso sa Senado na magsisilbing Impeachment Court at mapatunayang guilty ay matatanggal ito sa kanyang puwesto.

“Respondent committed culpable violation of the Constitution for failing to dispose of at least thirty seven (37) cases within twenty four months as mandated by Section 15 (1), Article VIII, in relation to Section 16, Article III of the Constitution, which mandates the prompt action and speedy disposition of cases,” ayon sa isinampang kaso.

“Next to Chief Justice Diosdado Peralta and Senior Associate Justice Estela Perlas-Bernabe, respondent is the third most senior Justice in the Supreme Court. Despite being third in line, respondent leads the race in having the most number of pending cases amongst his colleagues. The eighty-two (82) pending cases awaiting resolution are more than those of all the senior Justices combined,” dagdag pa sa reklamo.

Ayon sa reklamo, umaabot sa 82 kaso ang pending sa tanggapan ni Leonen kung saan 37 umano ay wala pang resolusyon kasama na ang forfeiture case laban kay Lucio Tan.

“Other dormant cases involved the allies of former president Aquino: the Confederation for Unity versus former Budget secretary Florencio Abad, Association of Small Accounting versus former

Finance secretary Cesar Purisima, Integrated Bar of the Philippines versus Purisima, Bagong Alyansang Makabayan versus former Transportation and Communication secretary Joseph Emilio Abaya, and Rep. Edcel Lagman versus former executive secretary Paquito Ochoa,” ayon pa sa reklamo.

Pinakamatanda umano sa kasong hindi inaaksyunan ni Leonen ang “Julie Parcon Song versus Lilia B. Parcon, na itinalaga sa kanya noong Jan. 10, 2013 at ang “Gemma dela Cruz versus Meralco na ibinigay sa kanya noong Mayo 2, 2014.

Bukod sa mga kasong inupuan ni Leonen sa Korte Suprema, itinuturing ding paglabag sa Saligang Batas ang mabagal na paresolba ng House of Representatives Electoral Tribunal (HRET) sa mga kasong nakahain dito.

Si Leonen ang presiding chairpeson ng HRET kung saan 34 ang election protest na inihain sa nasabing tribunal mula noong Oktubre 2019 subalit 30 pa umano ang pending at walang resolusyon gayong mahigit isang taon na ang nakalipas.

“When he became the chairperson of the HRET in October 2019, the thirty-four (34) pending cases in its roster hardly moved an inch,” ayon pa sa isinampang kaso.

“The remaining pending case of respondent involves a member of the Liberal Party which, as we all know, is the political party of former President AQUINO. In May 2019, Stella Quimbo (“QUIMBO” for brevity) ran for Congress (Marikina, 2nd district representative),” dagdag pa sa reklamo.

Pasok din umano si Leonen sa kasong Betrayal of Public Trust dahil sa kabiguin nitong ihain ang kanyang Statement of Assets, Liabilities and Net worth (SALN) noong 2004, 2005, 2006, 2007, 2010, 2011 na pagbalewala sa Saligang Batas at Republic Act (RA) 6713 o “Code of Conduct and Ethical Standards for Public Official and Employees”.

Isinama rin sa kaso ang tangkang paggastos ni Leonen ng halos P5 million para sa renovation ng isang Villa sa SC Compound sa Baguio City.

“It is shocking and appalling that respondent would even think of renovating a cottage in July 2020 — at the height of the COVID-19 pandemic. It is equally disgraceful that he would ask the Court to cough up 5 million pesos for the renovation of a summer cottage — when millions of Filipinos are starving because of the pandemic,” banggit pa sa reklamo at itinuturing ito na betrayal of public trust.

Nauna nang itinanggi ni Leonen ang paratang na siya ang nag-request ng renovation ng naturang cottage.

MATUTULAD KAY SERENO

Sa panayam ng SAKSI Ngayon kay Atty. Gadon, sinabi nitong dalawang klase ang kanilang nakitang basehan para sampahan ng impeachment si AJ Leonen.

Matibay aniya ang kanilang ebidensiya para ma-impeach bilang associate justice ng Korte Suprema si Leonen.

Dahil dito, maaari aniyang mahalintulad ang kapalaran ni Leonen kay dating Supreme Court Chief Justice Maria Lourdes Sereno sapagkat pwede rin itong ma-qou warranto.

Nakitaan aniya ng butas ng Office of the Solicitor General na maaaring sampahan ng quo warranto si Atty. Sereno sa unang pagdinig ng kanyang isinampang impeachment laban sa dating punong mahistrado.

Kung may masisilip din aniya ang OSG na dahilan para sampahan ng quo warranto si Leonen ay maaari itong gawin ng opisina ni OSG Jose Calida.

“HANDS-OFF”

Samantala, agad nagpahayag ang Malakanyang na wala itong kinalaman sa pagsasampa ng impeachment complaint laban kay Leonen.

Binigyang-diin ni Presidential spokesperson Harry Roque na ang impeachment complaint ay hindi inendorso ni Pangulong Rodrigo Roa Duterte.

“Wala pong kinalaman diyan. We don’t even know who the proponents are,” ayon kay Sec. Roque.

Matatandaan na si Gadon din ang siyang naghain ng reklamong impeachment laban kay dating Chief Justice Ma. Lourdes Sereno na napatalsik naman dahil sa quo warranto ng Supreme Court. (May dagdag na ulat sina JOEL O. AMONG/CHRISTIAN DALE)
