PINATAWAN si outgoing Surigao del Sur Rep. Prospero Pichay ng 18 taon hanggang 30 taong pagkakabilanggo at habambuhay na diskwalipikasyon sa paghawak ng pwesto sa gobyerno.

Ito’y matapos mahatulang ‘guilty beyond doubt’ ng Sandiganbayan Fourth Division ang kongresista sa kasong graft (3 counts) kaugnay ng P780 milyong pondo ng Local Water Utilities Administration (LWUA) taong 2009 bilang Chairman.

Sa 66-pahinang desisyon ng anti-graft court, hinatulang “guilty of gross inexcusable negligence” si Pichay dahil sa iregular na pagkuha sa 60% shares ng Express Savings Bank Inc. (ESBI), na aabot sa halagang P80 million, dagdag pa rito ang pagdeposito ng P300 milyon sa nasabing bangko at pagdaragdag ng kapital na aabot sa P400 milyon mula sa kaban ng LWUA.

“The prosecution was able to present sufficient evidence to prove that the irregular transactions carried out by the accused LWUA officials …were committed with gross inexcusable negligence. Ultimately, the absence of the requisite MB approval resulted in losses on the part of the government in the total amount of P780 million,” saad pa sa Sandiganbayan ruling.

Ayon sa korte, walang dudang dehado ang pamahalaan sa ginawa ni Pichay at iba pang nahatulan matapos balewalain ang mga takdang rekisitos na kalakip sa ilalim ng patakaran ng Office the President, Department of Finance (DOF), Bangko Sentral ng Pilipinas (BSP) – Monetary Board (MB), at ng Office of the Government Corporate Counsel (OGCC) salig na rin sa RA 8791 on General Banking Law of 2000 at Administrative Order No. 59.

“The records of the case bear witness to the repeated reminders of the different government offices to seek appropriate approval from the banking regulators before LWUA proceed with its resolution to create a bank or acquire an existing financial entity,” diin pa ng Sandiganbayan Fourth Division.

Nahaharap ang mga dating LWUA officials sa anim hanggang 10 taong pagkakakulong para sa bawat bilang ng kasong graft o katumbas ng 18 hanggang 30 taong pagkakabilanggo at “perpetual disqualification” sa paghawak ng anumang posisyon sa pamahalaan.

Nitong nakalipas na May 9 polls, si Pichay ay tumakbo para sa re-election bilang kongresista ng Surigao del Sur 1st. Dist. subalit nilampaso at tinalo ni Constructions Workers Solidarity (CWS) party-list Rep. Romeo Momo Sr.

Nauna rito, naglabas ang Supreme Court (SC) First Division na isang resolusyong tuwirang nagbasura sa consolidated petitions na inihain ng talunang Surigao del Sur lawmaker at kumakatig sa naunang hatol sa huli na pagpapataw sa kanya ng parusang ‘perpetual disqualification to hold any position in the government’.

Ang nasabing High Tribunal decision ay may kaugnayan din sa mga kasong isinampa laban kay Pichay hinggil kuwestyunableng P780-M LWUA-ESBI transactions. (FERNAN ANGELES)
