Hamon sa Executive department, Pharmally REPORT NG SENATE BLUE RIBBON COMMITTEE IDULOG SA SC

HINAMON ni Senador Richard Gordon ang executive department at ang Pharmally Pharmaceutical Corporation na dalhin sa Korte Suprema ang kanilang partial report na inilabas ng Senate Blue Ribbon Committee.

Una nang inilabas ni Gordon ang partial findings ng komite kung saan inirekomenda ang posibleng pagsasampa ng kaso laban kay dating Presidential Economic Adviser Michael Yang, mga dating opisyal ng Department of Budget and Management’s Procurement Service (DBM-PS) at mga executive ng Pharmally.

Partikular na pinasasampahan ng kasong perjury ang mga opisyal ng Pharmally na sina Linconn Ong at Krizle Grace Mago habang estafa laban kay Mohit Dargani.

Inirekomenda rin ng panel ang deportation laban kay Yang.

Kinuwestyon naman ng legal counsel ni Ong na si Atty. Ferdinand Topacio, ang tinawag nitong “piecemeal release” ng committee report.

Agad namang tumugon si Gordon na “Let him prove his case in the Supreme Court.”

Kinuwestyon din ni Gordon ang pahayag ni Topacio na walang awtoridad ang Office of the Senate Sergeant at Arms na arestuhin sina Pharmally executives Mohit at Twinkle Dargani dahil nasa labas sila ng gusali ng Senado.

Ang magkapatid ay na-cite for contempt dahil sa pagtangging isumite sa kumite ang mga dokumento ng transaksyon sa gobyerno.

“That statement is absurd. (For) example: a person had been sent a subpoena to either appear in person or to produce documents necessary for an investigation, in aid of legislation. And then that person does not appear or does not submit documents. Does the Senate wait for that person to enter the senate premises in order for that person to be cited for contempt and thus detained?” paliwanag ni Gordon.

“All that person will need to do is just not enter Senate premises so he or she won’t be held accountable for his or her recalcitrance,” dagdag ng senador.

“This will lead to a really stupid situation where a co-equal branch is rendered inutile because it’s supposed jurisdiction is restricted to where it’s building is situated,” giit pa nito. (DANG SAMSON-GARCIA)
