HINIMAY ng dating chairman ng House committee on appropriations na si Davao City Rep. Isidro Ungab ang mga iregularidad na ginawa aniya sa 2025 national budget sa Bicameral Conference committee na isang paglabag sa Saligang Batas.

Sa kanyang privilege speech noong Lunes ng hapon, tila ipinaliwanag ng mambabatas sa mga baguhang miyembro ng Kamara na ang 2025 national budget ay binubuo ng Programmed New Appropriations (PNA) na nagkakahalaga ng P4.247 trillion at Automatic Appropriations na P2.105 trillion kaya may kabuuang P6.352 trillion ang total expenditure Program ngayong taon.

Kasama aniya sa P4.247 trillion ang P158.6 billion na Unprogrammed Appropriations na maipatutupad lamang kapag nagkaroon ng sobrang koleksyon sa buwis o makautang ang gobyerno sa ibang bansa.

Sinabi ng mambabatas na base sa batas, tanging ang PNA ang puwedeng busisiin ng Kongreso subalit mahigpit na ipinagbabawal na dagdagan o bawasan ang AA o Automatic Appropriations dahil nakalaan ito sa National Tax Allotment (dating Internal Revenue Allotment o IRA), Interest Payment sa utang ng National Government, Retirement and Life Insurance Premiums or RLIP, Customs Duties and Taxes kasama na ang Tax Expenditures, BARMM Block Grant, Pension ng mga Ex Presidents/Spouses, Net Lending at Special Accounts in General Fund (SAGF).

“Mr. Speaker, as part of the budgetary process, Special Accounts in the General Fund and all the other Automatic Appropriations do not require annual legislative action by Congress. However, any amendments or upward amendments to these accounts may directly or indirectly increase the total Expenditure Program submitted by the President to Congress. This could potentially violate the Constitutional limitation on the appropriation of funds,” ani Ungab.

Ginawa ng mambabatas ang pahayag matapos matuklasan na mula sa P27.352 b billion na budget para sa SAGF na ipinanukala ng Pangulo o nasa orihinal na National Expenditure Program (NEP) ay dinagdagan ito sa Bicam ng P12.755 billion o 47% na pagtaas.

Dahil aniya sa ginawang ito sa pambansang pondo, lumobo ng P6,356,144,670,000 ang 2025 national budget mula sa orihinal na P6,352,390,000,000 na pinaaprubahan ni Marcos sa Kongreso dahil sa Bicam Adjustments sa SAGF na P12,754,670,000.

“Throughout my fifteen (15) years of service in this House, the items classified under Automatic Appropriations have remained absolutely intact. These appropriations have been consistently recognized and respected by the House committee on appropriations, its Senate counterpart, and both chambers of Congress as legally mandated expenditures that are explicitly protected by their enabling statutes. These automatic appropriations must not be subjected to alteration or amendment, as they constitute non-discretionary obligations established by law,” ayon pa kay Ungab.

Isiniwalat din ng mambabatas na maging ang ‘line item appropriation ng Department of Public Works and Highways (DPWH) para sa Special Road Funds ay pinakialaman umano sa Bicam.

Sinabi ni Ungab na ang orihinal na halaga sa Special Road Funds na nakapaloob sa NEP proposal ng Malacanang ay P16.756 billion lamang subalit pagdating sa Bicam ay P34.748 billion na ito o pinalobo ng P17.992 billion.

“…but here’s the problem, the P17.992 billion was not sourced from available balance of the Special Road Fund, but from pooled sources of funds or cuts and realignments from other agencies,” ani Ungab.

Paglabag anya ito sa Republic Act (RA) 11239 o Motor Vehicle User’s Charge na ang makokolekta sa buwis na binabayaran ng mga motorista ay gagamitin lamang sa construction, upgrading, repair, rehabilitation ng mga kalsada, pagpapatayo ng mga tulay at road drainage.

Bukod dito, kailangang isama aniya ito sa annual General Appropriations Act (GAA) at sa deliberasyon sa komite at maging sa plenaryo ng dalawang kapulungan subalit trinabaho lamang ito sa Bicam.

“Is it right to assume that if the increases are not supported by actual collections from the designated revenue sources, or if they alter the nature of the appropriations set by law, these adjustments may be legally questionable and vulnerable to constitutional challenge?,” ayon pa kay Ungab dahil base aniya sa nasabing batas, ang MVUC tax collection ay otomatikong nireremit sa Bureau of Treasury para sa Special Account sa General Fund.
