SUPORTADO ng mga kamag-anakan ng mga batang mag-aaral na nasawi diumano sanhi ng Dengvaxia vaccine ang legal na hakbang ng Office of the Solicitor General na buhayin ang na-dismiss ng Quezon City Regional Trial Court na walong kaso ng Dengvaxia.

Pinuri ni Sumachen Dominguez, pangulo ng Samahan ng mga Magulang, Anak at Biktima ng Dengvaxia, si Solicitor General Menardo Guevarra sa kanyang pagsasampa ng mga petitions for review on certiorari sa Court of Appeals upang kuwestyunin ang pagbasura ng QC RTC sa mga kasong kriminal na isinampa laban kay dating Health Sec. Janette Garin, ngayon ay Iloilo congresswoman, dating Philippine Children’s Medical Center director na si Julius Lecciones, Dr. Vicente Belizario Jr., Dr. Kenneth Hartigan-Go, Dr. Irma Asuncion, Dr. Maria Joyce Ducusin, Dr. Gerardo Bayugo, Dr. Rosalind Vianzon, Carlito Realuyo at Conchita Santos.

“This petition for Certiorari under Rule 65 of the Revised Rules of Court seeks to reverse, annul, and set aside the following issuances rendered by Respondent Judge Cleto R. Villacorta III, Presiding Judge of Branch 229, Regional Trial Court, Quezon City, in Criminal Case Nos. R-QZN-20-08619-CR, R-QZN-21-05256-CR, R-QZN-22-03837-CR, R-QZN-22-03938-CR, R-QZN-20–08618-CR, R-QZN-09218-CR, R-QZN-20-09662-CR, and R-QZN-20-03936-CR, all entitled People of the Philippines v. Dr. Janette L. Garin, et al.,” saad ni Guevarra sa kanyang petisyon.

Kinuwestyon rin nito ang mga kautusan ni Villacorta na sang-ayunan ang mga demurrer to evidence na inihain nina Garin at iba pang respondents.

“The Orders were issued with grave abuse of discretion amounting to lack or excess of jurisdiction, and there is no appeal or any plan, adequate, and speedy remedy in the ordinary course of law available against them,” diin niya sa kanyang petisyon sa Court of Appeals.

“Kami bilang mga magulang ay nagagalak na makahanap ng kakampi sa Office of the Solicitor General na makamit ang katotohanan,” saad ni Dominguez.

“Labis po kaming nalulungkot nang malaman namin na ang isinampa naming mga kaso ay nabasura lamang ng korte,” dagdag niya.

Noong Nobyembre 2017, naglabas ang Sanofi Pasteur Inc., ang vaccine manufacturer, ng isang official statement sa kanyang website na inaamin na ang Dengvaxia vaccine ay makapagdudulot ng adverse effects sa mga taong walang previous dengue infection.

“Dengvaxia provides persistent protective benefits against dengue fever in those who had prior infection. For those not previously infected by dengue virus, however, more cases of severe disease could occur following vaccination upon a subsequent dengue infection,” saad ng Sanofi.

Sa ilalim ng administrasyon ni Garin, ang DOH ay nag-procure ng Dengvaxia vaccine na nagkakahalaga ng P3.5 billion para sa mass vaccination ng mga mag-aaral sa mga pampublikong paaralan. (BENEDICT ABAYGAR, JR.)
