CARPIO NAGUGULUHAN SA BATAS-SALN – GADON

INAKUSAHAN ni Atty. Larry Gadon si retiradong Supreme Court Senior Associate Justice Antonio Carpio na “naguguluhan” sa krimen sa pagsunod at pagpapatupad ng batas hinggil sa State of the Assets, Liabilities and Net worth (SALN).

Ayon kay Gadon: “Justice Carpio is so confused. Integrity does not prescribe… because it is attached to the character of the person.”

Banat ito ni Gadon sa pananaw ni Carpio na: “Even if we assume, for the sake of argument, that Justice [Marvic] Leonen failed to file his SALNs while he was teaching at the University of the Philippines, any such crime has now prescribed. In the 2018 case of Melita del Rosario v. People of the Philippines, the Supreme Court ruled that the prescriptive period for failure to file a SALN is eight years. Justice Leonen left the University of the Philippines more than 10 years ago”.

Ipinaliwanag ni Gadon na: “prescription of a crime different, one may have been a corrupt public official whose crime of theft was not discovered and prosecuted that after ten years his crime has prescribed and that he can no longer be prosecuted … but remains a theft and corrupt official… the integrity was not cleansed.”

Idiniin ni Gadon na si Sereno ay natanggal sa Korte Suprema hindi dahil sa hindi nito paghahain ng kanyang SALN habang proposer sa U.P. kundi dahil sa kawalan ng integridad at kawalan ng katapatan sa pagsunod sa batas hinggil sa SALN. (NELSON S. BADILLA)
