HINILING ng Office of the Solicitor General (OSG)  sa Court Appeals (CA) na magpalabas ng warrant of arrest laban kay Senador Antonio Trillanes IV sa kasong coup d’etat kaugnay sa 2003 Oakwood mutiny.

Sa petisyon nito, inihirit ng OSG sa appellate court na ipawalang-bisa ang mga naging kautusan ni Makati RTC Judge Andres Soriano na nagbasura sa mosyon ng Department of Justice (DOJ) na mag-isyu ng arrest order.

Ayon sa OSG, nagkaroon ng grave abuse of discretion sa bahagi ni Soriano nang hindi ipaaresto si Trillanes.

Umapela rin ang OSG sa CA  na ibalik sa mababang korte ang kasong coup d’etat para ituloy ang pagdinig..

“An amnesty can only be valid if it is granted by the President pursuant to Section 19, Article VII of the 1987 Constitution, and the accused admits his guilt for the crime he was charged with,” the OSG told the appellate court.

Iginiit ng OSG na hindi balido ang ibinigay na amnestiya kay Trillanes noong 2011 dahil si dating Defense Secretary Voltaire Gazmin ang nagkaloob nito at hindi si dating Pangulong Noynoy Aquino.
